Copyright Notice and Conditions of Use

Last updated: 17/08/2026

EPEC Education owns and protects the intellectual property in its original course content, professional development materials, publications, and resources, and respects the rights in material it uses under licence from others.

This notice explains how EPEC Education's content may be used, what is prohibited, and what may happen if copyright or these conditions are breached. In this notice, "users" means any learner, client, purchaser, employee, contractor or other person who accesses EPEC Education content.

1. Copyright Ownership

Unless otherwise stated, EPEC Education owns the copyright in its original content.

Some content is owned by, licensed from, or reproduced with the permission of third parties. Any copyright notices, acknowledgements and licence conditions attached to that content must also be observed.

Accessing this website or an EPEC Education course does not transfer ownership of any intellectual property to a user.

2. Content Covered by This Notice

This notice applies to EPEC Education content made available through its website, aXcelerate, Thinkific, email, webinars, newsletters, publications, advertising and any other delivery modality.

Protected content includes:

  • Course and professional development materials
  • Learning and assessment resources
  • Newsletters such as “The Educator Brief”
  • Webinars
  • Lessons, modules and instructional text
  • Videos, audio and webinar recordings
  • Presentations, diagrams, images and graphics
  • Workbooks, templates, guides and handouts
  • Industry engagement meetings hosted by EPEC such as “The Sandbox Society”
  • Assessment questions, case studies and marking materials
  • Downloadable files and digital resources
  • Website content and industry blogs
  • Advertising materials
  • EPEC Education branding and original design elements

Copyright applies whether the content is provided free of charge or purchased.

3. Permitted Use

Unless different conditions are stated for a particular resource, an authorised user may:

  • Access the content for their own learning or professional development
  • Download or print materials where EPEC Education has enabled that function
  • Keep an authorised copy for singe use personal reference when authorised to do so
  • Use the material in line with the relevant enrolment, purchase or licence conditions
  • Use the content in any other way EPEC Education has approved in writing
  • Exercise any right that cannot lawfully be excluded or restricted

Access is granted to the authorised individual or organisation only. It does not create a general right to reproduce, distribute or commercially exploit the content.

4. Prohibited Use

Unless authorised in writing by EPEC Education or permitted by law, users must not:

  • Copy or substantially reproduce EPEC Education content
  • Share course access details, or let another person use an individual account
  • Upload content to shared drives, websites, learning platforms, social media or file-sharing services
  • Email, distribute, publish or otherwise make course resources available to others
  • Sell, licence, rent or commercially exploit the content
  • Take screen shots during webinars and other online presentations
  • Use the content to create or deliver another course, workshop or professional development product
  • Adapt, translate, modify or create derivative materials for distribution
  • Remove, obscure or alter any copyright notice, attribution, watermark or rights information
  • Record restricted lessons, webinars or course-player content
  • Reproduce assessment questions, answers, case studies or marking materials
  • Use automated tools to scrape, extract or compile protected content
  • Present EPEC Education's content as their own work

These restrictions apply to whole resources and to any substantial part of them.

5. Course and Professional Development Materials

Enrolment or payment gives an authorised user access to the relevant course or product under the applicable conditions. It does not transfer copyright, or allow the content to be resold, redistributed or reused in another training product.

Where an organisation buys access for multiple participants, access must stay within the number of authorised users covered by the purchase or written agreement.

Any workplace use, internal distribution, adaptation or reproduction beyond that authorised access must be approved by EPEC Education in writing before it occurs.

6. Assessments and Learner Submissions

Assessment questions, case studies, marking guides and related materials are protected and, in some cases, confidential.

Learners must not distribute assessment content or publish questions or answers online. Doing so also compromises assessment integrity and may result in action under EPEC Education's academic integrity, enrolment or assessment policies.

Learners keep any rights they hold in their own original work. By submitting work, a learner permits EPEC Education to use and retain it as reasonably required for assessment, quality assurance, compliance and recordkeeping, subject to applicable policies and law.

7. Third-Party Content

EPEC Education uses some third-party material under licence, permission or a statutory provision. Ownership of that material stays with the relevant rights holder.

Users must comply with any additional notices or restrictions displayed with third-party content. Permission from EPEC Education does not extend to third-party material, because EPEC Education does not hold the rights needed to grant it.

8. Suspected Infringement and Consequences

EPEC Education may investigate suspected unauthorised copying, sharing, publication, sale or other misuse of protected content.

Subject to the applicable agreement, organisational policies and law, possible responses may include:

  • Requesting that the activity stop
  • Requiring infringing copies or online material to be removed, including by issuing take-down notices to websites, platforms or hosting providers
  • Restricting or suspending access to EPEC Education systems or content
  • Taking action under applicable enrolment, assessment or service conditions
  • Terminating access where permitted by the applicable agreement
  • Seeking recovery of loss or other available civil remedies
  • Referring serious matters to the relevant rights holder, platform, legal adviser or authority

9. Legal consequences

Copyright in Australia is protected by the Copyright Act 1968 (Cth).

Where infringement is established, a court may order remedies including:

  • An injunction to stop the infringing conduct and prevent it recurring
  • Damages to compensate the copyright owner for its loss, or an account of profits made by the infringer
  • Additional damages, where the court considers it appropriate — for example, where the infringement was flagrant, where the infringer benefited from it, where deterrence is needed, or having regard to the infringer's conduct after being notified of the infringement
  • Delivery up or destruction of infringing copies
  • Payment of the copyright owner's legal costs

Separate criminal offences also exist under the Copyright Act 1968 (Cth) for more serious conduct — including infringement on a commercial scale, and making, selling, hiring, importing, distributing or offering infringing copies for trade. Depending on the offence, these can carry substantial fines and, in some cases, imprisonment. Significantly higher maximum fines apply to companies than to individuals.

Where content is misused by a student, employee, contractor or partner organisation, infringement may also give rise to consequences under the relevant enrolment, employment, contractual or professional obligations, and may be reported to the relevant employer, registered training organisation, professional body or regulator.

10. Requesting Permission

Permission must be requested before copying, adapting, distributing or otherwise using EPEC Education content beyond the permitted use described above.

A request should set out:

  • The requester's name and organisation
  • The material to be used
  • The proposed purpose
  • How and where the material will be distributed
  • The number of intended users or copies
  • Whether the use is commercial
  • The period of use required

Permission must never be assumed. It applies only once written approval has been received.

Please include where the material is located, a description of the suspected use, and any supporting links or screenshots.

12. Exceptions and Applicable Law

Nothing in this notice restricts a use permitted by law, or a right that cannot lawfully be excluded.

Whether a particular use is permitted depends on the circumstances. Anyone who is unsure should request written permission before proceeding.

This notice operates alongside applicable Australian law and the relevant enrolment, purchase, licence and service conditions.

13. Changes to This Notice

EPEC Education may update this notice when its content, systems, licensing arrangements or legal requirements change.
